Moshi man jailed 3 years for ‘killing’ mother

A MAN who killed his own mother unintentionally will spend three years in jail, after he pleaded guilty and asked for a lesser sentence in the High Court of Tanzania, Moshi Registry.

Before Justice Lawrence Mchome, was Satiel Reuben alias Mdowo (31), who pleaded to have committed the offence against her mother, the late Gundelisael Reuben on December 24, 2006 at Mamba Kimbogho village in Moshi District.

State Attorney Miss Rehema Katuga told Justice Mchome that on the fateful day, the accused had quarrelled with one Walter Massawe for unknown reasons. They were both drunk.

Suddenly, the accused picked a bush knife with a clear intention of hacking Massawe, but the deceased intervened with the view to put off the fight. However, in the struggle to snatch the said bush knife from the accused person, he accidentally cut the deceased on her right arm.

The deceased died on the spot due to excessive bleeding. The accused, who spent 23 months in remand prison, was arrested the following day. In his extra-judicial statement, he confessed to have caused the death of his mother with no malice aforethought. Meanwhile, hearing of an armed robbery case in which 243.2m/- was violently stolen from the volts of the National Micro-finance Bank is set to resume on January 19, according to court sources.

So far three prosecution witnesses – Kilimanjaro Regional Crimes Officer, Senior Superintendent of Police (SSP), Linus Sinzumwa, Inspector of Police Grace Lyimo and former armoury in-charge at Mwanga police station, police constable Hamad have testified.

The accused in this case are two Kenyan nationals – Samwel Gitau Saitoti and Michael Kimani Peter, as well as ten Tanzanians – Calist Kanje, Deodat Temu, ex-F. 940 police constable Nathaniel Manyama, Emmanuel Mziray, Florian Kimati, Devota Msanze, Juliana Msanze, Elizabeth Msanze, Ntibasalila Msanze and Salome Matemu. According to the facts of the case presented in court by the prosecution, each accused person had a role to play before, during and after the commission of the crime.
